International Seller Terms and Conditions

These International Seller Terms and Conditions (“Terms and Conditions”) shall be applicable to you when you place an order through any of the sellers located outside India (“International Sellers”). Notwithstanding anything contained here in, these Terms and Conditions are not applicable when you place an order for any product listed in the Raavna Store by Raavna Export Sales, LLC. In which case the Raavna Store Terms and Conditions will apply.

While placing your orders with International Seller, you understand and acknowledge that

(1) you are placing your order with the International Seller,

(2) these products have not yet been imported into the India at the time of purchase, and

(3) the sale takes place in the jurisdiction where the International Seller is located, and therefore, you agree that such sale is subject to the laws and regulations of the country from which the International Seller is selling the product and the courts of such country will have the exclusive jurisdiction. In addition to these Terms and Conditions, the Terms of Use and Conditions of Use from Raavna.store will also apply. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. This clause is without prejudice to your rights to enforce your consumer protection rights in connection with these Terms and Conditions in India.

If any provision of these Terms and Conditions conflicts with the Raavna.store Terms of Use or Conditions of Use, the conflict shall be resolved in the following order of priority: (1) these Terms and Conditions, (2) Terms of Use, and (3) Conditions of Use.

Responsibility for Importation

When ordering products from International Sellers, you are responsible for lawfully importing the product into the India and act as the importer on record for customs purposes into India. The risk of loss and title for such products that you purchase from the International Seller pass to you upon the delivery of such product to the carrier. You may be subject to taxes and fees levied by Indian customs and tax authorities which are included in the price of the product paid by you at the time of purchase. For each product which you purchase from an International Seller, you authorize the International Seller to designate a carrier (“Designated Carrier“) to act as your agent with the relevant customs and tax authorities, to carry out the customs clearance for the merchandise, process and pay the taxes and fees levied by Indian customs and tax authorities for such items. You agree that you will be the final consumer of the product or that you will be giving the product to another individual as a gift, and in any case that the product is being purchased for personal use only and not for resale or for any commercial use. Should you wish to obtain documentation or receipts in connection with customs clearance, you may contact the Designated Carrier specified in your shipment confirmation e-mail. You agree to grant the authorizations, as set out in Annexure-1, on behalf of yourself or the receipt designated in case of gifts or other purchases made on behalf of another recipient in your order for products purchased from the International Sellers.

If any provision of these Terms and Conditions conflicts with the Raavna.store Terms of Use or Conditions of Use, the conflict shall be resolved in the following order of priority: (1) these Terms and Conditions, (2) Terms of Use, and (3) Conditions of Use.

Warranties for Products purchased from International Sellers

For products purchased from International Sellers, warranties and other after-sale services provided by manufacturers may not apply outside of the country from which the products are shipped.

Returns, refunds, and title

The International Seller does not take title to returned items until the item arrives at its fulfillment center or such other place as it may designate. The International Seller, at its discretion, may elect to issue a refund without requiring a return or taking title to the refunded item. With respect to items sold by the International Sellers, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items offered may be mispriced. If the correct price of an item sold by the International Seller is higher than the stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. 

Liability

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE INTERNATIONAL SELLER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RAAVNA WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

ANNEXURE – 1

POWER OF ATTORNEY AND AUTHORIZATION LETTER

I/ We, the Importer on Record (“IoR“), having an interest in the merchandise that is in the package as described in the invoice, hereby grant this Power of Attorney (“PoA“) to the relevant International Seller (“International Seller”) having sold the product to the IoR to designate the Designated Carrier (as defined below) to clear my/ our imported package(s) that I/ we have purchased through the Raavna website. This PoA further authorizes the Designated Carrier to provide services for transportation, brokerage and customs clearance processes in India on my/ our behalf. Further, as the IoR, I/ we hereby authorize the Designated Carrier to provide this document to Indian Customs and CBEC agents and authorities as per the Annexure to the Customs Circular No.9/2010 (www.cbec.gov.in/htdocs-cbec/customs/cs-circulars/cs-circulars-2010/circ09-2k10-cus ).

I/ we further confirm, that I/ we provide this PoA to the International Seller and the Designated Carrier by agreeing to the terms and conditions of the International Seller while placing the order by clicking “Place Your Order” during the checkout process.

I/ we hereby authorize the carrier and/ or broker designated by the International Seller (together with its affiliates and its and their respective customs clearance and other agents, collectively, the “Designated Carrier“), to:

(a) act as my/ our agents and to do all acts necessary on my/our behalf including to file all documents, declarations and Bills of Entry for customs/ octroi clearance of all import shipments at landed cost that are consigned to or by me/ us through the courier through express or formal customs clearance mode; and

(b) file all documents on my behalf that may be necessary for import customs clearance of shipments based on the declaration and information regarding the goods provided to the Designated Carrier as a result of my/ our purchase on the Raavna website.

This PoA shall remain valid and continue in full force and effect until revoked in writing and acknowledged by the Designated Carrier in writing and shall cover all my/ our shipments purchased from the International Seller and sent to my/ our address in India. This authorization may be produced and presented before any customs station in India as formal authorization to the Designated Carrier for customs clearance of my/ our shipments by the Designated Carrier.
